I am still a beginner artist, and my avatars may not be perfect or highly optimized. I am constantly learning and improving, but I kindly ask you to consider this before purchasing.

If you are looking for ultra-polished or perfectly optimized avatars, my creations might not meet those expectations.

All products sold through this shop are intended for individuals 18 years of age or older.

By purchasing any avatar or digital product, you are confirming that you are at least 18 years old and legally permitted to access and use this type of content in your country or region.

If it is discovered that a buyer is under the age of 18, they will be:

• Privately Blacklisted from the server and the shop,
• Have their access to purchased content revoked,
• And will not be eligible for a refund.

This policy exists to ensure compliance with platform standards and to protect both the creator and the community.

By purchasing from my shop, you agree not to resell, redistribute, or share any part of the product package with anyone else, under any circumstance.

This includes:

• Uploading the avatar as a public avatar on VRChat
• Placing it in a public world
• Or sending files to anyone that is not yourself.
• Sharing files on leaking and ripping sites

All avatars are licensed for personal use only, and you are the only person allowed to use the files you purchased.

You are responsible for your files

If you share your files with anyone and they end up leaked, you will be held accountable.

It does not matter how the file was leaked or who leaked it.

If the file left your possession, it is a violation of the TOS.

Each file is uniquely watermarked and can be traced back to the original buyer. If it appears on a public leak site, the buyer will be identified and blacklisted.

What you can share

You are allowed to share .spp (Substance Painter Project) files with others for texture commissions.

However, you may not share:

• The Unity package or project
• The FBX or model files
• Any assets included in the original avatar package

Sharing these is a direct violation of the TOS and will result in action taken against you.

To protect my work and support fellow creators, I have implemented a strict policy against verified cases of avatar file leaks to public piracy or leak sites.

This policy does not apply to minor TOS violations or honest mistakes. It only applies in serious, verified cases of intentional leaking. I retain the final say on whether a violation is considered serious or not.

Once you purchase an avatar, the file is uniquely stamped with identifiable information linked to your order. If that file is found on a public leak site, the original buyer will be held responsible.

We do not differentiate between the individual who directly uploaded the file and the person who purchased it if the file left your possession, it constitutes a breach of these terms.

This policy applies from June 26, 2025 forward. Past incidents will not be retroactively added to the blacklist.

What qualifies for public blacklisting:

• A file from my store is discovered on a public leak/piracy site.
• If the leak is confirmed using Payhip’s Anti-Leak system or if there is solid proof.
• I cannot access customer-stamped files unless they have been leaked to the public.

If you're found leaking:

• Your Discord username and Discord ID may be added to a public blacklist, visible to other creators and community members to help prevent future leaks.
• Your Payhip Payer ID may be shared with trusted creators who are verified in the server and run active shops (Payhip, Gumroad, Jinxxy, etc.).
• Your email address and real name will never be posted publicly, but may be privately recorded for legal or administrative purposes.
• You may still be privately banned or warned if suspicious behavior is detected, even if it does not result in public listing.

This blacklist exists to help protect creators from file leaks, support accountability, and create a safer space for avatar developers. It is not meant to shame — it's about preventing damage to our work and community.

Please make sure to fill out the purchase form correctly when buying any product from my shop.

Failure to do so will result in an automatic and permanent blacklist and ban.

If you want to gift one of my avatars to someone else, you must use the gift option at checkout.

If you accidentally purchase it for yourself instead, do not download anything.

Contact me immediately, and I will issue a refund so you can repurchase it the correct way.

When the gift option is used correctly:

• The recipient will receive the files directly via their email.
• The purchaser is not allowed to use, download, or claim ownership of the files.
• If the purchaser also wants access to the files, they must buy a separate copy for themselves.

Any misuse of the gift option or attempt to “double dip”, split price or other actions of this kind will be treated as a violation of the TOS and may result in a private blacklist entry.

You must have basic knowledge of Unity to upload your avatar.

I do not offer one-on-one help with uploads, and I will not hold your hand through the process.

Trusted Uploaders

If you're unable to upload your avatar yourself, there are trusted uploaders in my Discord server who can assist you for a $5 fee.

Please understand that response times may vary due to real-life responsibilities and time zones.

Not allowed:

Getting my Avatars uploaded by someone that is not a TRUSTED UPLOADER in my Disocrd Server is strictly not allowed and instantly punished with a ban and private blacklist.

You must either:

• Upload it yourself
• Or request help from one of my trusted uploaders

Avatars marked as "❥Old Avatar" in the product description under the TOS section are exempt from the upload service.

These avatars are considered legacy items and may be broken or outdated. They are intended only for users who are comfortable fixing them themselves.

Public Uploads

Uploading any of my avatars as public is strictly prohibited.

This includes:

• Setting the avatar to public in VRChat or any other platform
• Sharing it as a public cloneable avatar
• Uploading it “just for a friend” or under the assumption that “no one will use it”
• As a part of a world even if not clonable ask for my permission first!

All avatars are for private use only, and public uploads are never allowed under any circumstances.

Avatars marked as "❥ Old Avatar" in the product description under the TOS section are considered legacy avatars that may be outdated or broken due to changes in Unity, shaders, or VRChat updates.

These avatars are still available because there is continued demand, and keeping them listed publicly saves me from having to send private links to those who still want them.

Important:

• Do not purchase these avatars unless you are confident in your ability to fix or update them yourself
• I will not be updating or fixing these avatars going forward
• These are sold strictly as-is, and support will not be provided
• Frequent updates to Unity, shaders, and VRChat may cause these avatars to break or require manual adjustments

These avatars are intended for users who are comfortable working with broken or outdated content and understand that they will not receive updates or fixes.

If you’re not sure whether you can handle this, it’s better to consider one of my more recent, actively supported avatars.

Some Quest-compatible versions included with my avatars are community-made and not created, tested, or officially supported by me. These versions are shared with my permission by generous community members and are included as a free bonus in the package.

Because I do not create or maintain these community-made versions myself, I cannot guarantee their quality or functionality. They may have issues, lack features, or be held to a different standard than the official PC version.

• Please do not purchase avatars solely for Quest compatibility.
• We do not offer support for community-made Quest versions.
• By purchasing, you acknowledge that these Quest versions are unofficial and provided as-is, with no guarantees.

Important:

This does not apply to Quest versions that are created by me directly.

If a Quest version was officially made and supported by me, it will be clearly stated in the avatar’s product description!

I generally do NOT allow commercial use of my products unless it is explicitly stated in the product description.

If you're unsure whether commercial use is allowed, please feel free to ask me in my Discord server!

Redistributing edits and assets that include files from the original avatar:

You are ONLY allowed to redistribute an edited version of my avatars if both you and the recipient are verified in my Discord server.

For example:

If you make an edit such as modifying the body to be chubbier or slimmer and you wish to share it with someone else, you must make sure the recipient is verified via a verification ticket in my Discord server.

You can check if someone is verified by looking at their server profile under the “Purchased” section.

(❗IMPORTANT: The role “Avatarname PING” is NOT a verification role and does not confirm that someone is verified.)

This process ensures that the person you're sharing with legally owns the original avatar.

Discord Community Market

My Discord server includes a community market dedicated to assets and content created specifically for my avatars.

This is the safest and most TOS-compliant way to share or access edits, retextures, or custom content for my avatars.

Assets made for my avatars, including meshes or any parts of the original avatar, are not allowed to be shared or advertised outside of the community market in my Discord server.

This ensures that all modifications, content, and shared resources remain within a trusted and verified environment.

You are allowed to sell custom textures and original assets for my avatars outside of the Discord Server, as long as none of the original avatar’s components are included.

If you make an asset for my avatars, feel free to post it in my Discord server, I’d love to see what you’ve made!

Comissioning

If you want to commission someone to work on one of my avatars, both you and the person you're commissioning must legally own the files and be verified in my Discord Server

Join my Discord server and open a verification ticket, and we will verify both purchases.

You are allowed to use my avatars on social media platforms like TikTok, Instagram, YouTube, Twitch, and similar platforms, both for personal and monetized content.

If you use my avatars in any type of content, you must credit me in either the video/post description or visibly within the content itself.

This applies to:

• TikToks, Reels, Shorts
• YouTube and Twitch streams
• VRChat videos, skits, promos
• VTuber/streamer performances
• Any platform where you present the avatar

You are also allowed to use my avatars on subscription-based platforms like OnlyFans, Fansly, or Patreon, including for NSFW or monetized content, but credit is required in the description of each post or in a permanent visible location.

You may not:

• Use my avatars in any way that promotes hate speech, harassment, racism, or illegal activity.
• Use the avatar models for training AI datasets or uploading them to any AI training tool/site.
• Export or use my models in NFTs, blockchain projects, or crypto-based promotions.

Do not extract or reuse any parts or assets from my avatars.

All third-party assets used in my avatars are always linked in the product description for proper credit and sourcing.

If an asset isn’t credited, it was either made by me or I simply forgot to list it — feel free to ask in my Discord server if you're unsure! I'm always happy to help.

You are NOT allowed to:

• Swap the head or body of my avatars with other models not even between my own avatars
• Use any part of my avatars (like faces, limbs, or bodies) to create your own avatars, bases, or mashups
• Extract assets for reuse on other projects especially ones that aren’t part of my shop
• Reuse any third-party assets included in my avatars (even when mix-and-matching between my own avatars)
• Always refer to the original creator’s TOS in these cases!

You are allowed to:

• Add or change clothing, accessories, or other small cosmetic details
• Mix and match ears, tails, and clothing made by me between avatars that were also made by me

However:

• You may not use ears, tails, or clothing from my avatars on avatars I did not create
• You may not extract third-party parts and reuse them — even between my own avatars unless that use is clearly allowed by the original creator or you have purchased your own license to use the content.

You are allowed to create an OC (original character) using my avatar as a base.

However, simply using the default avatar without any changes and calling it your OC is not allowed.

You must personalize or modify the avatar in a meaningful way to make it your own character while still complying with the rest of my TOS.

You are welcome to commission artists to draw your OC based on my avatar, but you must:

• Make sure your OC is different enough from the original avatar’s design
• Do not commission art of the base avatar without telling the artist that the original design is mine
• Send the artist a link to my TOS when commissioning them, so they understand the usage terms

You are not allowed to sell, adopt out, or commercialize any character that is based on one of my avatars without my explicit permission.

Doing so is a direct violation of the TOS and may result in removal from the server and blacklist action.

This does not apply for texture adopts directly tied and made for to my avatars

You are free to edit my avatars however you like, as long as it complies with the rest of my TOS and does not violate any other section.

If you're ever unsure, feel free to ask in my Discord server. I’m always happy to answer questions!

All of my avatars are fully finished character designs, not avatar bases.

They are created with specific creative intent and personality, and are not meant to be blank slates or highly customizable templates.

All edits must align with the rest of my tos and must be made on your end, as I do not offer custom edits or adjustments beyond what is included in the original design.

Please ensure that the avatar fits your vision before purchasing, or be confident that you have the skills to make the edits you want.

Refunds will not be issued due to personal preference or inability to make changes.

Feedback on Avatar Functionality

I always welcome feedback, especially regarding bugs, functionality, or technical improvements.

That said, design choices are intentional and reflect the personality and aesthetic of the character, so requests to change the design based on personal taste will not be implemented.

I can offer a refund only if the product has NOT been downloaded.

Once the file has been accessed or downloaded, I cannot issue a refund, all sales are final for digital products.

This is because there is no way to verify that the files have been deleted from your device after download.

Products purchased on Jinxxy are non-refundable.

Please make sure to double-check the product details and TOS before buying.

Breaking any part of the Terms of Service will result in immediate action, including but not limited to:

• Restricted Access – Loss of access to support, updates, and any remaining download credits. No refunds will be issued.
• Blacklist / Ban – Permanent blacklisting from all future purchases, updates, and access to any community spaces, including my Discord server.
• Legal Action – Serious violations such as reselling, redistributing, or sharing my avatars or their assets may result in legal consequences.

By purchasing and using my avatars, you are confirming that you have read, understood, and agreed to all terms listed in this TOS.
